Buying workers’ compensation in a “monopolistic” state

If your business is located in North Dakota, Ohio, Puerto Rico, the US Virgin Islands, Washington, or Wyoming, or if your business has any employees working in those locations, you’ll need to buy your workers’ compensation coverage for those employees directly through a state-run workers’ comp bureau. By law, no private insurance carriers can sell workers’ comp in these “monopolistic” states/territories — so known because they hold a monopoly on workers’ comp insurance.

This rule only applies to workers’ comp; private insurers are allowed to operate and sell other types of business insurance in the monopolistic states/territories, including general liability, business owner’s policies (BOPs), professional liability, and other property and casualty coverages.
